These Terms constitute a legally binding agreement between you and 64Skillls governing your access to and use of our multi-path career ecosystem platform. Please read them carefully before using any of our services.

Introduction & Acceptance of Terms

Welcome to 64Skillls ("Company," "we," "our," or "us"). These Terms & Conditions ("Terms") constitute a legally binding agreement between 64Skillls and any individual, employer, recruiter, organization, visitor, or user ("User," "you," or "your") who accesses, registers for, or uses our Platform.

64Skillls operates a career ecosystem, job portal, recruitment marketplace, freelancing platform, mentorship network, and educational opportunities platform (collectively, the "Platform"), inspired by the timeless wisdom of the ancient 64 Kalas.

✅ Agreement Acknowledgement

By accessing or using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, that you comply with all applicable laws, and that you possess the legal capacity to enter into a binding contract. If you do not agree, you must immediately discontinue use of the Platform.

Eligibility Requirements

  • You must be at least 18 years of age or the legal age of majority in your jurisdiction
  • You must possess full legal capacity to enter into binding contracts
  • If acting on behalf of a corporate entity, you must hold explicit authority to bind that entity
  • You must not be prohibited from using the Platform under any applicable law

64Skillls reserves the right to verify eligibility at any time and to deny or revoke access at its sole discretion.

User Accounts & Security

Account Registration & Accuracy

Users may be required to create an account to access certain Platform features. You agree that all information provided during registration and throughout your use of the Platform shall be accurate, current, complete, and truthful. If we have reasonable grounds to suspect that any profile information is false, deceptive, or inaccurate, we reserve the right to suspend or terminate the account immediately without liability.

Password Safety & Account Responsibility

  • You are solely responsible for maintaining strict confidentiality of your account credentials
  • All activities and agreements executed under your account are deemed your responsibility
  • You assume full legal and financial responsibility for all account activity
🔔 Immediate Notification Required

You must notify us immediately at info@64skillls.com upon discovering any unauthorized account access, suspected security breach, or credential compromise.

Account Suspension & Termination

64Skillls reserves the right to suspend, restrict, or permanently terminate accounts without prior notice if:

  • False or misleading information is provided
  • These Terms are materially violated
  • Fraudulent or deceptive conduct is detected
  • Illegal activities are discovered
  • Platform security is threatened
  • Law enforcement requests are received
  • Subscription fees remain unpaid (Employers)
  • Platform policies are repeatedly breached

Termination does not eliminate any legal obligations or liabilities arising before the date of termination.

Rules for Job Seekers

Profile Accuracy & Resume Integrity

Job Seekers must ensure all information submitted to the Platform is completely accurate and truthful. Your resumes, educational credentials, employment histories, portfolio items, certifications, and skill assessment answers must be entirely free from fraud, misrepresentation, or exaggeration.

🚫 Strictly Prohibited

Job Seekers shall not submit fabricated resumes, misrepresent qualifications, falsify employment records, forge certifications, provide inaccurate references, impersonate another individual, or upload portfolios to which they do not hold intellectual property rights. Providing false information may result in immediate account termination and legal action.

Content License Grant

By uploading resumes, profiles, portfolios, certifications, photographs, or other content, Job Seekers grant 64Skillls a non-exclusive, worldwide, royalty-free, perpetual, sub-licensable license to store, reproduce, display, distribute, and format such content solely for operating the platform and rendering profiles searchable to registered Employers. You retain full ownership of your underlying content.

Application Responsibility & Hiring Outcomes

  • Employers make independent hiring decisions — 64Skillls has no control over their choices
  • 64Skillls does not guarantee employment, job offers, interviews, or career advancement
  • Hiring outcomes depend entirely on employer requirements and individual qualifications
  • Interview invitations and candidate selection are at the employer's sole discretion

Rules for Employers & Recruiters

Legitimate Opportunities Only

Employers and Recruiters may only post valid, currently active, and legally compliant career opportunities. All job postings must accurately describe the role's responsibilities, compensation terms, location requirements, and qualification criteria. Permitted types include employment positions, internships, freelance projects, consulting engagements, and professional contracts.

🚫 Prohibited Recruitment Activities

Employers shall not post MLM opportunities, pyramid schemes, chain marketing programs, get-rich-quick schemes, opportunities requiring upfront financial investment from candidates, misleading advertisements, or any illegal employment offers. 64Skillls reserves the right to remove any posting at its sole discretion without notice or refund.

Non-Discrimination Compliance

All job listings, selection parameters, interview evaluations, and hiring processes must comply with applicable labor, employment, and anti-discrimination statutes. Employers shall not discriminate based on:

  • Race or ethnicity
  • Nationality or national origin
  • Religion or caste
  • Gender or sexual orientation
  • Disability or health status
  • Age or marital status
  • Political affiliation
  • Any other legally protected characteristic

Candidate Data Protection

Employers are granted access to Job Seeker resumes, assessment scores, and portfolios solely for internal recruitment purposes related to active vacancies on the Platform.

  • Candidate data shall be treated as strictly confidential and used only for recruitment evaluation
  • Candidate records shall not be sold, leased, or shared with unauthorized third parties or data brokers
  • Industry-standard security measures must be maintained to protect all candidate information
  • Unauthorized use of candidate data may result in account termination and legal proceedings

Prohibited Activities & Misuse

You are granted a limited, non-exclusive, non-transferable, revocable license to access the Platform strictly in compliance with this Agreement. Any unauthorized usage will result in immediate termination of this license and may result in legal proceedings.

No hacking, password attacks, security testing without permission, system intrusion, or vulnerability exploitation.

Automated Scraping & Bots
No scraping scripts, bots, spiders, crawlers, or automated data extraction tools without written authorization.

System Abuse & Malware
No malware, viruses, ransomware, DDoS attacks, server overloading, or interference with Platform functionality.
🎮
Fraud & Impersonation
No impersonating others, identity fraud, phishing, recruitment scams, or creating fake accounts.
📈
Reverse Engineering
No copying, decompiling, disassembling, or reverse engineering the Platform's source code or proprietary frameworks.
🗎
Spam & Unsolicited Contact
No bulk unsolicited messages, spam campaigns, or unauthorized commercial solicitations to other users.
⚠️ Consequences

Violations may result in immediate account termination, permanent bans, civil lawsuits, and/or criminal prosecution under applicable cybercrime and computer misuse legislation.

Fees, Payments & Subscriptions

Paid Services

Certain services require payment including premium employer subscriptions, featured job postings, resume database access, recruitment tools, advertising placements, and career enhancement services. By purchasing paid services, you authorize 64Skillls or its PCI-DSS compliant payment processors to charge applicable fees.

Automatic Renewal

Unless explicitly stated otherwise in a written corporate agreement, subscriptions operate on an automatic renewal cycle — billed monthly, quarterly, or annually per your selected plan. You authorize recurring charges until you cancel through your billing management portal.

📅 Fee Changes & Notice

We reserve the right to modify fee schedules at any time with 30 days advance email notification to your registered billing address.

Refund Policy

🚫 Non-Refundable

Unless required by applicable law, all payments are non-refundable. Cancellations stop subsequent renewal charges but do not yield pro-rated refunds for unused portions of the current billing cycle. Promotional purchases are non-refundable. Discretionary refunds may be granted on a case-by-case basis.

Tax Responsibility

Users remain solely responsible for all applicable taxes, duties, government charges, and regulatory fees (including GST where applicable) associated with Platform transactions in their respective jurisdictions.

Intellectual Property Rights

Company Ownership

Except for user-submitted content, all right, title, and interest in and to the Platform are the exclusive intellectual property of 64Skillls, protected under international copyright, trademark, and unfair competition laws. Protected materials include:

  • Software code & databases
  • Website design & UI/UX frameworks
  • Logos, graphics & visual identity
  • Content, text & narratives
  • Trademarks & trade secrets
  • Proprietary algorithms & diagnostic models

The 64Skillls name, logo, and taglines are protected trademarks and may not be used without prior written authorization. No ownership rights are transferred to users.

User Content Ownership

Users retain intellectual property rights over the text, images, portfolios, and content they upload or transmit through the Platform. You represent that you possess all necessary clearances and legal authority to distribute your content within our ecosystem.

DMCA Copyright Takedown Procedure

If you believe material on the Platform infringes your copyright, submit a formal notification to info@64skillls.com containing:

Physical or electronic signature of the copyright owner or authorized representative

Clear identification and description of the copyrighted work claimed to have been infringed

Specific URL or location on the Platform where the infringing material is hosted

Your complete contact details: name, address, telephone number, and email address

A good faith statement that use of the material is not authorized by the copyright owner, its agent, or the law

A statement under penalty of perjury that the notification is accurate and you are authorized to act on behalf of the owner

Third-Party Links & Services

The Platform may contain links to third-party websites, APIs, payment solutions, background verification services, and study-abroad portals.

🔗 Third-Party Disclaimer

64Skillls does not endorse, control, monitor, or assume legal or financial liability for any third-party content, services, data practices, terms, or security standards. Your interactions with external platforms are governed solely by their independent terms and privacy policies. Users access all external services entirely at their own risk.

Where Employers utilize third-party background verification or screening services via the Platform, 64Skillls bears no responsibility for the accuracy, completeness, or outcomes of such results. Those transactions are executed directly between the Employer and the independent provider.

Disclaimers & Limitation of Liability

Platform Provided "As Is"

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without representations or warranties of any kind, either expressed or implied. To the fullest extent permitted by law, 64Skillls disclaims all warranties, including implied warranties of merchantability, fitness for a specific purpose, data accuracy, internet security, and non-infringement.

No Guarantee of Career Outcomes

⚠️ Important Disclaimer

64Skillls does not guarantee employment opportunities, job offers, interviews, career advancement, candidate quality, hiring success, or any specific financial outcome. Actual career results depend entirely on individual effort, market conditions, employer decisions, and economic factors beyond the Company's control.

Limitation of Financial Liability

To the maximum extent permitted by applicable law, 64Skillls shall not be liable for lost profits, lost business opportunities, loss of data, reputational harm, or indirect, consequential, incidental, special, or punitive damages arising from your use of or inability to access the Platform.

💵 Financial Liability Cap

The total aggregate financial liability of 64Skillls for any claims arising under this Agreement shall not exceed the lesser of: (a) the total fees paid by you in the three (3) months immediately preceding the event giving rise to liability, or (b) INR 10,000 / USD 150 — whichever is lower.

Indemnification

You agree to defend, indemnify, and hold harmless 64Skillls, its affiliates, directors, officers, employees, contractors, agents, and partners from and against any claims, damages, liabilities, losses, costs, and expenses — including reasonable attorney fees — arising from:

  • Violation of these Terms or any applicable law or regulation
  • Your user content, job descriptions, resumes, or uploaded portfolios
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any employment disputes, recruitment disputes, or hiring-related claims
  • Fraudulent conduct, misrepresentation, or misuse of the Platform
  • For Employers: violation of any labor, workplace safety, or anti-discrimination statutes
🔧 Defense Rights

We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate fully with our defense of such claims. This indemnification obligation survives termination of these Terms.

Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Telangana, India, without regard to conflict-of-law principles.

Mandatory Binding Arbitration

Any dispute, conflict, or claim arising from or relating to these Terms — including its formation, validity, interpretation, performance, or breach — shall be finally resolved by binding arbitration administered under the Arbitration and Conciliation Act, 1996 (India), before a single neutral arbitrator.

Language: English
Effect: The arbitral award shall be final, binding, and may be entered as an enforceable judgment in any court of competent jurisdiction.

Class Action Waiver

🚫 Class Action Waiver

You and the Company explicitly agree that all disputes shall be resolved strictly on an individual basis. You hereby waive any right to initiate, join, or participate in a class action lawsuit, collective arbitration, or representative action against the Company to the maximum extent permitted by applicable law.

Injunctive Relief

Notwithstanding the arbitration clause, 64Skillls may seek immediate injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, platform security, or legitimate business interests where irreparable harm would otherwise result.
